Martinez filed <a href=\"http:\/\/www.capitol.state.tx.us\/BillLookup\/History.aspx?LegSess=84R&amp;Bill=HB3040\">HB 3040<\/a> to allow economic development corporations to build transportation infrastrcture. \u00a0<\/p>\n<p>Refreshing our recollection, Chairman Pickett asked about County Transportation Reinvestment Zones but Attorney General Opinion said the Texas constitution probably prohibits it.\u00a0<\/p>\n<p>\u00a0<\/p>\n<p><strong>Previously on Information Intelligence:<\/strong><\/p>\n<p>Attorney General Opinion,\u00a0<a href=\"https:\/\/www.texasattorneygeneral.gov\/opinions\/opinions\/51paxton\/op\/2015\/kp0004.pdf\">KP-004<\/a>, tells us without a constitutional amendment, a county probably cannot:<\/p>\n<ul>\n<li>Create a County Energy Transportation Reinvestment Zone<\/li>\n<li>Create a County Transportation Reinvestment Zone<\/li>\n<li>Create a County Tax Increment Reinvestment Zone<\/li>\n<\/ul>\n<p>The AG rational is that:<\/p>\n<ul>\n<li>Article VIII, Section 1(a) doesn&#8217;t permit counties to create these zones<\/li>\n<li>Because the Constitution requires taxation to be equal and uniform<\/li>\n<li>And, a county reinvestment zone would treat property inside the zone and outside the zone differently<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rep.
