Airports, Trains, Hospitals, oh my!"},"content":{"rendered":"<p><a href=\"http:\/\/www.ilga.gov\/legislation\/BillStatus.asp?DocNum=4150&amp;GAID=14&amp;DocTypeID=HB&amp;LegId=108258&amp;SessionID=91&amp;GA=100\">Illinois House Bill\u00a04150\u00a0<\/a>\u00a0accomplishes two goals:<\/p>\n<ul>\n<li>limits the use of eminent domain to only public uses<\/li>\n<li>explicitly removes railroads from public use<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>If a private entity is involved in the project the following 6 steps must occur:<\/p>\n<ul>\n<li>\u00a0the condemning authority must prove by a <strong>preponderance of\u00a0<br \/>\n\tthe evidence<\/strong> that:<\/p>\n<ul>\n<li>(i) the acquisition of the property is\u00a0<strong>necessary<\/strong> for a public purpose;<\/li>\n<li>(ii) the acquired property will\u00a0be <strong>owned by the condemning authority or another governmental\u00a0entity;<\/strong> and<\/li>\n<li>(iii) the acquired property will be controlled by a\u00a0private party that operates a business or facility related to\u00a0the condemning authority&#8217;s operation of a:\n<ul>\n<li>university<\/li>\n<li>\u00a0medical\u00a0district or\u00a0hospital<\/li>\n<li>exposition or convention center<\/li>\n<li>mass\u00a0transportation facility, or airport, including<\/li>\n<li>but not\u00a0limited to:\n<ul>\n<li>\u00a0a medical clinic<\/li>\n<li>\u00a0research and development center<\/li>\n<li>food or commercial concession facility<\/li>\n<li>social service\u00a0facility, maintenance or storage facility, cargo facility,<br \/>\n\t\t\t\trental car facility, bus facility, taxi facility, flight\u00a0kitchen, fixed based operation, parking facility, refueling\u00a0facility, water supply facility, and railroad tracks and<br \/>\n\t\t\t\tstations.\u200b<\/p>\n<p><a href=\"https:\/\/thevedette.com\/rep-parkhurst-files-legislation-to-strengthen-private-property-rights\/\">The Vedette |\u00a0Rep.
