The details:"},"content":{"rendered":"<p><a href=\"http:\/\/www.house.state.tx.us\/_media\/pdf\/committees\/reports\/84interim\/Special-Purpose-Districts-Committee-Interim-Report-2016.pdf\">House Committee on Special Purpose District 2016 interim committee report<\/a> makes the following recommendations:<\/p>\n<ul>\n<li>Follows Senate IGR to recommend committee policy changes requiring local notices for annexation &amp; MMDs before legislation is considered\u00a0<\/li>\n<li>Use of standard MMD language<\/li>\n<li>A committee check list:\n<ul>\n<li>Enforce existing and additional notice requirements outlined in Recommendation No. 1 (Notice requirements);<\/li>\n<li>Enforce the use of the MMD Standard Language described in Recommendation No. 2a (Standard MMD language);<\/li>\n<li>Clearly differentiate between the various types of special district legislation heard by the Committee and focus on the relevant questions and issues by type<\/li>\n<li>Document local support for the creation of an MMD; and<\/li>\n<li>Confirm that a bill proposing to create an MMD does not contain provisions that the\u00a0Committee or the Legislature generally consider unacceptable.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>Committee Red Flags for MMD legislation:\n<ul>\n<li>The power of eminent domain;<\/li>\n<li>Elections to be held on non-uniform election dates;<\/li>\n<li>Levy of sales tax in excess of the maximum rate allowed by general law;<\/li>\n<li>Issuance of water, sewer, and drainage bonds without TCEQ approval (as required by Section 375.208, Local Government Code);<\/li>\n<li>Issuance of bonds secured by property taxes without an election; and<\/li>\n<li>Levy of a property tax without an election.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>Chapter 375, Local Government Code should be reformed like in <a href=\"http:\/\/www.capitol.state.tx.us\/BillLookup\/History.aspx?LegSess=84R&amp;Bill=HB3097\">2015&#8217;s HB 3097<\/a> to include:\n<ul>\n<li>A majority-in-value of landowners requirement for petitions to create new MMDs through the TCEQ;<\/li>\n<li>The ability of the owners of a majority of the assessed value of property subject to assessment by the MMD to recommend the appointment of persons to the MMD board of directors; and<\/li>\n<li>A lowering of the threshold of landowner petitions required for dissolution of an MMD from \u201c75% or more\u201d to \u201cat least two-thirds.\u201d\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>From November 2016, informed:intel:<\/p>\n<p><a href=\"http:\/\/www.lrl.texas.gov\/scanned\/interim\/84\/L786.pdf\">The Senate IGR Interim Committee Report\u00a0<\/a>has a laundry list of municipal management district (MMD) reforms.
