More"},"content":{"rendered":"<p>In 2014 California passed a number of data security bills to protect students, consumers and patients, including:<\/p>\n<ul>\n<li>\n<p><strong>Privacy Rights for California Minors in the Digital World<\/strong>\u00a0(California&#8217;s SB 568)<\/p>\n<ul>\n<li>\n<p>\u00a0Prohibits marketing or advertising alcohol, firearms and tobacco\u00a0to minors<\/p>\n<\/li>\n<li>\n<p>Prohibits\u00a0using, disclosing, or compiling a minor\u2019s personal information (or permitting a third party to do so).<\/p>\n<\/li>\n<li>\n<p>Intended to exceed federal protections for minors.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><strong>Data Breach Notification Amendments<\/strong>\u00a0(California&#8217;s\u00a0AB 1710):<\/p>\n<ul>\n<li>\n<p>\u00a0Business must \u201cimplement and maintain reasonable security procedures and practices appropriate to the nature of the information, to protect the personal information from unauthorized access, destruction, use, modification, or disclosure.\u201d\u00a0<\/p>\n<\/li>\n<li>\n<p>Any identity theft prevention services\u00a0must be made at no cost to the affected person for not less than 1 year.\u00a0<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Medical Information Breach Notification Period<\/strong>\u00a0(California&#8217;s\u00a0AB 1755):\n<ul>\n<li>Expands\u00a0the time permitted to report breaches or disclosures of patients\u2019 medical information to the state &amp; to the patient.\u00a0\u00a0<\/li>\n<li>Permits email notification.<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><strong>Safeguarding Pupil Digital Records<\/strong>\u00a0( California&#8217;s\u00a0AB 1584):<\/p>\n<ul>\n<li>\n<p>Provide local educational agencies\u00a0with control to contract with third parties that provide digital educational software or services, including cloud-based services, for the digital storage, management, and retrieval of pupil records.\u00a0<\/p>\n<\/li>\n<li>\n<p>Limits\u00a0the use of the pupil records, ensuring compliance with the federal Family Educational Rights and Privacy Act<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><strong>Pupil Records and Social Media<\/strong>\u00a0(California&#8217;s AB 1442):<\/p>\n<ul>\n<li>\n<p>Restricts a school district, county education office, or charter school that gathers information from an enrolled pupil on social media from using information collected for other purposes.<\/p>\n<\/li>\n<li>\n<p>Prohibits\u00a0selling or sharing of information, and imposes other requirements related to the destruction of information.\u00a0<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><strong>Student Online Personal Information Protection Act<\/strong>\u00a0(California&#8217;sSB 1177):<\/p>\n<ul>\n<li>\n<p>&#8220;Prohibits operators of websites and online services and applications used primarily for K\u201312 school purposes, and designed and marketed for those purposes, from pursuing targeted advertising to students and their parents or legal guardians.&#8221;<\/p>\n<\/li>\n<li>\n<p>&#8220;Prohibits using covered information to build a profile of K\u201312 students, selling a student\u2019s information, and disclosing certain types of information.&#8221;
